Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of ChatPesa (the "Platform"), operated in Kenya. By creating an account, browsing gigs, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use ChatPesa.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to register for a ChatPesa account. You must also hold a valid Kenyan M-Pesa registered number in your own name to receive payouts, since all earnings are paid directly to the M-Pesa number on file.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering, including your name, phone number, email address, and M-Pesa payout number, and to keep this information up to date.

You may not create more than one account, transfer your account to another person, or allow another person to use your account.

4. Gigs, tasks and payment

ChatPesa lists chat moderation, messaging, email reply and related gigs sourced from partner businesses. By applying for and completing a gig, you agree to follow the guidelines provided for that specific task.

• Payment for completed and verified tasks is credited to your ChatPesa balance and is withdrawable to your M-Pesa number, subject to the minimum withdrawal amount for your plan.
• ChatPesa reserves the right to review submitted work for quality and compliance with task guidelines before releasing payment.
• Rates displayed for each gig are subject to change and are confirmed at the time you apply.
• ChatPesa does not guarantee a minimum number of available gigs at any given time.

5. Acceptable use

You agree not to use the Platform to:

• Impersonate another person or misrepresent your identity to any partner business, customer, or other user;
• Solicit money, gifts, or personal information from any individual you interact with through a gig, outside the scope of the task guidelines;
• Submit fraudulent, plagiarized, or automated (bot-generated) task completions;
• Attempt to create multiple accounts to claim gigs more than once;
• Use the Platform for any unlawful purpose, including fraud, harassment, or the facilitation of scams of any kind.

Violation of this section may result in immediate suspension of your account and forfeiture of pending, unverified earnings.

6. Fees and subscriptions

ChatPesa's Free plan is free to join and use. Optional Pro and Business subscription plans are billed monthly as described on the Subscription page, and may be cancelled at any time from your Dashboard. ChatPesa never charges a fee to apply for or complete a standard gig.

7. Intellectual property

All content on the Platform, including the ChatPesa name, logo, and design, is the property of ChatPesa or its licensors and may not be copied, reproduced, or used without prior written permission.

8. Suspension and termination

ChatPesa may suspend or terminate your account at its discretion if you breach these Terms, provide false information, or engage in conduct that harms other users, partner businesses, or the Platform. You may also close your account at any time by contacting support.

9. Disclaimers and limitation of liability

The Platform is provided "as is." ChatPesa does not guarantee uninterrupted availability of gigs, a specific income level, or that any particular gig will remain available. To the fullest extent permitted by law, ChatPesa is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles.
